The provider works as a self-employed professional (autónoma) registered in Spain. These Terms and Conditions (the “T&C”) govern the contractual relationship between the provider and the client for all services offered through the website.

2. Services offered

2.1 Custom professional web development

Creation of custom professional websites, including design, structure, strategic content, technical development, performance, scalability, SEO and a complete digital presence.

Price: from EUR 2,600, set by quotation according to the scope of the project.

Terms: this service is governed by a specific project contract, agreed in writing between the parties before work begins. The project contract prevails over these T&C as regards scope, milestones, delivery times and special conditions. Where the project contract contains no specific provisions, these T&C apply.

Standard payment plan: 50% on signing the contract and starting the project; 25% on reaching the agreed stage of progress; 25% as the balance before going live. The website is not published until the final balance has been received.

2.2 Technical audit for websites and blogs

Technical analysis of existing websites and blogs to identify technical issues, structural problems, performance problems, incorrect configuration and aspects relating to technical SEO, cookies and tracking. Includes a 60-minute call, a written report delivered within 48 hours and email support for 7 days after the report is delivered.

Price: EUR 350 (fixed).

2.3 Technical audit of AI workflows and systems

Analysis of the workflows, automations and AI tools already used by the client to identify issues, inefficiencies, operational risks and opportunities for improvement. Includes an initial call for analysis and context gathering (60 minutes), an operational report with workflow mapping, priorities and recommendations, and a final review call (45 minutes). Implementation of the work identified is available as an additional service, on a separate quotation.

Price: EUR 690 (fixed).

2.4 Operational support (bug fixing and technical assistance)

Tailored technical service for bug fixes, urgent corrections, code problems and emergency work on existing websites and digital products.

Price: hourly rate set by quotation, following the provider’s technical assessment of the type and complexity of the work. The service is subject to the client’s acceptance of the quotation.

Prices are expressed in EUR. The Canary Islands are excluded from the EU VAT area: EU VAT does not apply. Services provided to clients established or resident outside the Canary Islands are exempt from IGIC (Impuesto General Indirecto Canario) under article 17 of Law 20/1991. IGIC at 7% applies only to clients established or resident in the Canary Islands. Prices may be updated; the version in force is the one published on the website at the time of booking.

3. Booking and conclusion of the contract

Services are booked through the TidyCal platform, accessible via the links on the website. The contract is concluded when the booking and payment, made through PayPal or Stripe, are confirmed.

Before paying, the client must read these T&C and the Privacy notice. Completing the booking process implies full acceptance of these T&C.

For the custom professional web development service, the contract is concluded by signing the specific project contract, not by the booking alone.

4. Cancellation and refunds — Fixed-price consultations

The following policy applies to the services in sections 2.2, 2.3 and, where applicable, 2.4.

4.1 Cancellation before the service is provided

The client may cancel or ask to reschedule the session at any time before the service is provided.

  • Cancellation with a request to reschedule: no charge. The session is rescheduled to a date agreed between the parties.
  • Cancellation without rescheduling: full refund of the amount paid, processed within 14 working days using the same payment method.

4.2 Right of withdrawal for consumers (B2C) — Waiver

Under article 103 of Royal Legislative Decree 1/2007 (TRLGDCU) and Directive 2011/83/EU, consumers have the right to withdraw from the contract within 14 days of its conclusion without giving any reason.

However, under article 103(a) TRLGDCU, the right of withdrawal is lost when the service has been fully performed, provided that:

  • performance began with the consumer’s prior express consent, and
  • the consumer acknowledged that they will lose the right of withdrawal once the contract has been fully performed by the professional.

Waiver statement — Before paying, the client must explicitly accept the following statement by ticking a mandatory checkbox on TidyCal: “I consent to the immediate performance of the service and acknowledge that, once the service has been fully provided, I will lose the right of withdrawal under article 103 of the TRLGDCU and Directive 2011/83/EU.” Without this acceptance, the booking cannot be completed.

For clients acting in the course of their professional or business activity (B2B), the 14-day right of withdrawal does not apply.

4.3 Digital withdrawal function (Directive (EU) 2023/2673)

Under Directive (EU) 2023/2673, amending Directive 2011/83/EU, and the applicable implementing legislation, the provider makes a digital withdrawal function available to consumers directly on the website for the whole period during which the right of withdrawal can be exercised.

The function is available on the page studiojable.com/en/legal/right-of-withdrawal or by writing to recesso@studiojable.com

The provider sends an acknowledgement of receipt of the withdrawal statement on a durable medium (email) without undue delay, stating the content of the statement and the date and time it was received. The right of withdrawal is deemed to have been exercised within the deadline if the statement is sent before it expires.

Where the consumer has accepted the waiver in section 4.2 and the service has been fully provided, the right of withdrawal is extinguished and the withdrawal function does not apply to the contract concluded.

5. Cancellation and refunds — Custom web development

Cancellation conditions for the web development service are set out in the specific project contract. Unless the contract provides otherwise, the following applies:

  • Before the project starts (before the 50% deposit is paid): no charge.
  • After the 50% deposit is paid and before the first milestone: partial refund assessed on the basis of the work already done.
  • After work has started: no refund for the stages already completed. The parties will agree in writing how the material produced up to that point is to be delivered.

The 50/25/25 payment plan is binding. Payment of the final 25% balance is a necessary condition for publishing the website. The provider reserves the right not to release the production files until full payment has been received.

6. How the services are provided

Consulting and audit services are provided remotely, online. Sessions take place by video call on the platform agreed between the parties at the time of booking.

The provider undertakes to deliver the services with professional diligence and in line with industry best practice. Consulting and audit services are an obligation of means, not of result: the provider does not guarantee that specific traffic, ranking or conversion goals will be achieved.

The client is responsible for providing the provider with all the information, access and materials needed to deliver the service. Delays attributable to the client are not the provider’s responsibility.

7. Intellectual property

All material produced by the provider as part of the services (reports, analyses, documents, source code, design) remains the provider’s property until full payment has been received.

Once payment has been completed, the client acquires a full and permanent licence to use the material delivered for the agreed purposes. The provider reserves the right to mention the project in their portfolio, unless otherwise agreed in writing with the client.

Pre-existing material supplied by the client (content, images, existing code, trademarks) remains the client’s property. The client warrants that they hold the necessary rights to all the material supplied.

8. Limitation of liability

The provider is not liable for:

  • indirect damage, loss of profit, loss of data or consequential damage arising from the use of, or inability to use, the services;
  • interruptions of third-party services (hosting, platforms, plugins, AI tools) beyond the provider’s control;
  • SEO ranking or performance results that depend on search engine algorithms subject to changes beyond the provider’s control;
  • damage arising from inaccurate or incomplete information provided by the client.

In any case, the provider’s maximum liability is limited to the amount paid by the client for the specific service in dispute.

9. Confidentiality

Both parties undertake to keep confidential all confidential information exchanged in the course of the services (business data, strategies, technical access, commercial information). This obligation remains in force for 2 years after the end of the contractual relationship.

The processing of personal data is governed by the Privacy notice

10. Changes to services and prices

The provider reserves the right to change the services offered, the prices and these T&C at any time. Changes apply to contracts concluded after the date of publication of the updated version. Contracts in progress are not affected by the changes, unless otherwise agreed in writing between the parties.

11. Governing law and jurisdiction

These T&C are governed by Spanish law, in particular Royal Legislative Decree 1/2007 (TRLGDCU) for relationships with consumers and the Spanish Civil Code (Código Civil) for relationships between professionals.

In the event of a dispute, the parties undertake to seek an amicable solution. Failing that, the courts of Las Palmas de Gran Canaria (Spain) have jurisdiction, without prejudice to any mandatory provisions in favour of the consumer under applicable law.

Complaints

To make a complaint, the client can write to hello@studiojable.com, stating the service purchased and the reason for the complaint. The provider replies in writing.

The provider is not a member of any alternative dispute resolution body for consumer disputes. If the complaint is not resolved directly, the consumer can turn to an accredited body, such as the Junta Arbitral de Consumo de Canarias.
